1. Acceptance of Terms
By engaging the services of CREDFLOW LLC ("Company," "we," "us," or "our"), you ("Client") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and CREDFLOW LLC. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.
2. Services Provided
CREDFLOW LLC provides professional debt collection services in accordance with all applicable federal and state laws, including but not limited to:
- Fair Debt Collection Practices Act (FDCPA)
- Fair Credit Reporting Act (FCRA)
- Telephone Consumer Protection Act (TCPA)
- Health Insurance Portability and Accountability Act (HIPAA) where applicable
- All relevant state and local regulations
Our services include:
- Commercial (B2B) debt collection
- Consumer debt collection
- Healthcare debt collection
- Skip tracing and debtor location services
- Legal collections and judgment enforcement
- International debt recovery
3. Client Obligations
Clients who place accounts with CREDFLOW LLC agree to:
- Provide accurate, complete, and current information about all debts placed for collection
- Verify that all debts are valid and legally enforceable
- Notify us immediately of any payments received directly from debtors
- Cooperate with our collection efforts and provide additional documentation as requested
- Maintain the confidentiality of debtor information
- Comply with all applicable laws and regulations
Clients represent and warrant that:
- They have the legal right to collect the debts placed with us
- The debts are not disputed (unless disclosed)
- All information provided is true and accurate
- They will not attempt to collect on accounts placed with us
4. Fee Structure
CREDFLOW LLC operates on a contingency fee basis:
- No upfront fees or costs
- Fees are only charged on amounts successfully collected
- Fee percentages vary based on:
- Age of accounts
- Dollar amount of debt
- Type of debt (commercial vs. consumer)
- Volume of accounts placed
- All fees will be agreed upon in writing before collection efforts begin
- Legal fees and court costs may apply for accounts requiring litigation
5. Legal Compliance
CREDFLOW LLC maintains strict compliance with all applicable laws:
5.1 FDCPA Compliance
- No harassment or abuse of debtors
- No false or misleading representations
- No unfair practices
- Proper validation of debts upon request
- Respect for cease and desist requests
5.2 Communication Practices
- No contact before 8:00 AM or after 9:00 PM (debtor's local time)
- No contact at debtor's place of employment if prohibited
- No communication with third parties except as permitted by law
- All communications are professional and respectful
5.3 Data Security
- 256-bit SSL encryption for all data transmission
- Secure data storage with regular backups
- Limited access controls and authentication
- Regular security audits and updates
6. Limitation of Liability
To the maximum extent permitted by law:
- CREDFLOW LLC's liability is limited to the fees collected on the specific account in question
- We are not liable for indirect, incidental, special, or consequential damages
- We are not responsible for the accuracy of information provided by clients
- Our maximum liability shall not exceed the fees paid to us in the twelve months preceding the claim
6.1 Indemnification
Client agrees to indemnify, defend, and hold harmless CREDFLOW LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Inaccurate or false information provided by the client
- Invalid or illegal debts
- Client's breach of these Terms
- Client's violation of any laws or regulations
7. Termination
Either party may terminate the service agreement:
- With 30 days written notice
- Immediately upon material breach by the other party
- Fees for collections in progress remain due and payable
- Client obligations survive termination
Upon termination:
- We will cease all collection activities
- Final accounting will be provided within 30 days
- All client data will be returned or destroyed per client instructions
9. Miscellaneous
9.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
9.2 Dispute Resolution
Any disputes shall be resolved through binding arbitration in Broward County, Florida, in accordance with the American Arbitration Association rules.
9.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
9.4 Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior agreements and understandings.
